If you upload a video of an unconscious person being sexually assaulted on OnlyFans, you’ll be banned immediately. But if you’re a student at Villanova University and record the sexual assault of an unconscious person and do nothing to stop it, nothing will happen to you.

In 2022, a young Villanova student was sexually assaulted by fellow student, Elijah Joseph Katzenell, in his dorm room. His roommate, Andrew Polun, allegedly “assisted” with the assault but was never charged for the crime. And in the course of the investigation it was revealed that Juan Eguiguren was also in the same dorm room as the assault occurred. Instead of trying to help the survivor or stop Katzenell or Polun, he pulled out his phone and recorded it. The police found the video on his phone, and it was reported that the survivor was unconscious as the assault took place.

Katzenell ultimately pled guilty to the assault, though he did not serve any prison time. Instead, he was sentenced to seven years of probation, one year of house arrest, lifetime registration as a sex offender, and a court order to stay away from both the victim and Villanova University.

Katzenell had already left the university by the time he pled guilty, as had Polun, but Eguiguren is still a student for a few more weeks. That’s when he was set to walk at graduation, right alongside the survivor whose sexual assault he recorded.

The female student whose name has remained anonymous has filed a civil suit against the university and the three male students who were allegedly involved. Her lawyer Jay Edelstein said, “As we got closer to graduation, it really started to eat her up. “Almost as if she was going to be assaulted again by having to go through this whole thing and hearing his name and walking.”

Other students were outraged when they learned that Villanova refused to keep Eguiguren from walking at graduation. One student said, “It was unacceptable. And to learn the administration wasn’t taking action broke my heart.”

Another student added, “We’re here for her. And that we will stand up for her when the school didn’t. We’re going to be there for her and make sure that this is a moment. She deserves to be heard.”

It seems she was heard, though not by the university. Eguiguren announced that he will not be walking, after all, but not because of the university. He decided on his own after more than 25,000 people signed a petition asking Villanova to stop him.

It took thousands of students to try to get Villanova to hold Eguiguren accountable for recording the assault. But if he’d uploaded that footage to OnlyFans, he would have been banned immediately. OnlyFans is a subscription-based platform that primarily features X-rated content creators, and it requires users to provide important information like proof of their age, identification, and consent. And you are banned immediately if you post any non-consensual acts or if someone in the video appears to be unconscious.

While it would be better if universities would work to stop sexual assault on their campuses entirely, the least they could do is show more support for students who do survive these experiences by not allowing those involved in their assault to remain on campus — especially not to share the stage at graduation.
